Acceptable Use of Our Services
Terms and Policies
You are required to use our Services in compliance with our Terms and posted policies. Any violation may result in actions taken regarding your account, including disabling it. Should this occur, you agree not to create another account without our permission.
Legal and Acceptable Use
You agree to access and utilise our Services solely for legal, authorised, and acceptable purposes. It is prohibited to use (or assist others in using) our Services in ways that:
(a) infringe upon the rights of MobeX, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights;
(b) are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or promote conduct that is illegal or inappropriate, such as inciting violence or exploiting vulnerable individuals;
(c) involve disseminating false or misleading information;
(d) impersonate another individual;
(e) involve transmitting illegal or impermissible communications.
Safeguarding MobeX and Fellow Users
You must refrain from (or assist others in) accessing, using, copying, modifying, distributing, licensing, sublicensing, or otherwise exploiting our Services in unauthorised or impermissible manners. This includes actions that could burden, impair, or harm MobeX, our Services, systems, or any users. Specifically, you must not (directly or indirectly, through automated means):
(a) reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Services;
(b) transmit viruses or harmful computer code through our Services;
(c) gain or attempt to gain unauthorised access to our Services or systems;
(d) interfere with or disrupt the safety, security, or performance of our Services;
(e) create accounts through unauthorised or automated means;
(f) collect user information in an impermissible manner;
(g) distribute our Services over a network for simultaneous use by multiple devices, except as authorised;
(h) create software or APIs that replicate our Services and offer them to third parties without authorisation; or
(i) misuse of reporting channels, including submitting fraudulent or groundless reports.
Protecting Your Account
You are responsible for safeguarding your device and your MobeX account. Please notify us immediately of any unauthorised use or security breaches related to your account or our Services.
MobeX Licenses
Your Entitlement
At MobeX, we respect your ownership of the information you provide when creating your account or using our Services. You affirm that you possess all necessary rights to the information you submit.
MobeX’s Entitlement
We retain exclusive ownership of all copyrights, trademarks, domains, logos, trade secrets, patents, and other intellectual property associated with our Services. You may not utilise our intellectual property without obtaining our permission.
Your Authorisation To Use MobeX
To ensure the effective operation of our Services, you grant MobeX a license to use, create derivative works from, display, and perform the information (including content) you upload, submit, store, send, or receive through our Services. This license is granted solely for the purpose of providing and running our Services (for instance, allowing us to display your profile picture and status messages, or transmit your messages).
MobeX’s Authorisation To You
We provide you with a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to access and use our Services in accordance with our Terms. This license is intended solely to enable you to use our Services as permitted.
Indemnification
In the event that a third party files a claim against us related to your actions, information, or content on MobeX, or any other way you use our Services, you agree to indemnify and protect the MobeX team from any liabilities, damages, losses, and expenses (including reasonable legal fees) that arise from: (a) your access to or use of our Services; (b) your violation of our Terms or the law; or (c) any misrepresentation you may have made. We appreciate your cooperation in helping us defend against any such claims.
Service Accessibility and Termination
We are committed to enhancing your experience with our Services, which may involve adding, modifying, or removing features and support for certain devices and platforms. Our Services may occasionally be interrupted for maintenance, upgrades, or due to unforeseen issues beyond our control. We may also decide to discontinue some or all of our Services at any time.
Your access to our Services can be modified, suspended, or terminated for any reason, especially if you violate our Terms or if your actions pose risks to us, our users, or others.
Additional Information
Unless we have a different agreement in place, these Terms represent the complete agreement between you and us regarding MobeX and our Services, replacing any prior agreements.
Our Services are not intended for use in locations that would contravene local laws or regulations. We reserve the right to restrict our Services to any specific region.
Any changes or waivers to our Terms proposed by you will require our approval.
We may update or modify these Terms from time to time. By continuing to use our Services, you agree to these Terms. If you do not agree, please discontinue your use of our Services by deleting your account.
We retain the right to transfer our rights and obligations under these Terms to our affiliates or in the event of a merger, acquisition, or sale, and we may also transfer your information accordingly. Should this happen, these Terms will still govern your relationship with the new entity. If you disagree with such a transfer, you must stop using our Services by deleting your account after being informed of the transfer.
Our compliance with the law remains paramount and is not limited by these Terms.
We value your feedback and suggestions about MobeX and our Services. While you are not required to provide feedback, any suggestions you do share can be utilised by us without any obligation to compensate you.
